EEMJ's Car Rental Services herein also referred to as the “COMPANY” hereby agrees to lease a vehicle as described hereof to the any individual (“RENTER”) who shall comply and agrees with the terms and conditions as below stated:

 

USE AND PURPOSE: The Lessee hereby expressly agreed and warrants that the rented vehicle shall be used by them solely for their purpose of travel as approved by the LESSOR in their Reservation Agreement. The LESEE is strictly prohibited from using the said vehicle for any other purpose without prior written consent of the LESSOR.

 

COMPLIANCE WITH LAWS AND REGULATIONS: The LESSEE shall comply with all the rules and regulations and laws in the used of vehicle leased vehicle, including those with respect to fire, sanitation, and public safety. The LESSEE hereby assumes full responsibility for any violations hereof during the existence of the lease.

 

RIGHTS OF THE LESSEE NON- TRANSFERABLE: The LESSEE shall not further sub-lease the vehicle or any part of the vehicle.

 

LESSOR NOT LIABLE: The LESSOR is not liable to the LESSEE and the LESSEE will not make a claim against the Lessor in respect of any liability resulting from any loss, accident, death, injury, damage to the passengers, other parties and any property arising out or in connection with the Lease Agreement in the use or preparation of the Vehicle being used under this contract.

 

CONDITIONS:

• The LESSEE acknowledges that prior to the making of this lease, the LESSEE has examined the vehicle and confirms that it is in good condition.

• Excess hours will be charged _________

• Deviation of declared destination will be charged accordingly

 

RULES INSIDE THE VEHICLE:

• No smoking inside the vehicle any damages of such act will be charged to the Lessee accordingly whichever is higher.

• No person is allowed to drink alcoholic beverages, doing drugs and gambling inside the vehicle. A penalty of Php100,00.00 will be charged as damages and the lessor has the right to report the incident to the nearest police station and file a case against the persons involved.

• All accessories of the vehicle are functioning in good condition, failure to return it the same way, the Lessee has to pay certain charges of damages, including the number of days that the vehicle cannot operate because of the condition of the vehicle is not fit to operate.

 

RESPONSIBILITY FOR LOSS OR DAMAGE TO THE VEHICLE. Lessee is responsible for the FULL VALUE regardless of fault. Whatever breaks in the rented vehicle is the LESSEE’s responsibility to repair/restore back to original in the LESSOR.

• IN CASE OF DAMAGE TO VEHICLE. Lessee must secure Police Report, photocopy of driver’s license, and will cover all repair expenses plus 100% of the Daily Rate while the vehicle is in service by Nissan Cagayan de Oro.

• FLAT TIRES WHILE RENTAL: Flat tires incurred by the Lessee while on rental, vulcanizing charges shall be for the account of the Lessee.

• LOST/ DAMAGE KEYS: Lessee failure to return car keys is automatically charged with fee of Php7000.00

AUTHORIZED DRIVER:

The Lessee agree that it shall not allow its qualified and authorized driver to perform any act that may endanger the driver and his passengers and other parties or put in danger the condition of the vehicle. Accordingly, the Lessee shall not allow the use of unauthorized driver.

 

The Lessee shall not allow the driver to drive the vehicle while intoxicated or under the influence of drugs and contraband.

TRAFFIC LAW VIOLAITION:

The Lessee agrees to obey traffic laws. If the Lessee fails to make such, Lessee will pay all the fines and penalties to any traffic violation, plus all cost incurred in the event. Lessee agrees that, in connection with any claimed violations, any information, relating to Lessee, may be submitted to government authorities.

 

FAILURE TO RETURN VEHICLE:

 

If the LESSEE fails to return the vehicle on the due date and time without a permitted extension from the LESSOR, the LESSEE will be deemed to be unlawful possession of the vehicle and alarm the authorities and will be reported as car nabbed.

 

LIABILITY FOR LOSS AND ACCIDENT:

 

If the leased vehicle has been lost/car nabbed or in any case that the lessee can’t return the vehicle, then the LESSEE is responsible for the whole amount of the rented vehicle, it is based on the selling price of the vehicle at __________________.

 

In case of Total Wreck – if the rented vehicle has been damaged severely that it can’t be fixed, the lessee is responsible in paying the whole amount of the rented vehicle based on selling price of the car indicated above exclusive of the insurance liability within 7 days from date of accident/loss.

JURISDICTION:

 

That the parties agreed to submit themselves to the exclusive jurisdiction of the proper court of competent jurisdiction holding session in the City of Cagayan de Oro.
